Response of the UN Office of Legal Affairs concerning the application of the proposed new revision of the Agreement to type approvals issued under the previous revision. The OLA offers an unofficial response categorically stating that the Contracting Parties determine the application of the Agreement and that unless otherwise stated, the new revision applies to approvals issued after the date that the new revision enters into force.

Proposals to amend the guidelines concerning the establishment of UN Regulations and transitional provisions (WP.29/1044). Earlier proposals were developed in document SG58-17-04/Rev.1.

Information on WP.29 plans to introduce an automated system that would generate consolidated versions of UN Regulations and GTR, including all amendments and corrections, at the time each enters info force. This system may also allow for the generation of earlier versions of each regulation according to the past date selected.

Table on the status of the proposals adopted at the November 2014 WP.29 session. These proposals, with one exception, became binding on 15 June 2015 following the six-month statutory waiting period.

Updated draft set of guidelines prepared by the WP.29 secretariat concerning the submission and adoption of modifications to UN Regulations, especially taking into consideration the pending Revision 3 to the 1958 Agreement which envisions, among other things, the acceptance to multiple “versions” of each regulation. This document covers: amendments resulting from draft Revision 3; publication of new series of amendments; long transitional provisions; versions of UN Regulations; use of cross-references; amendment commencement dates; consolidation of amendments to once per year; and use of “compilations” of modifications.

The pending Revision 3 to the 1958 Agreement opens the way for virtual or simulation testing for use in type approvals. This presentation considers the proposed amendment and its application to mechanical coupling approvals.

Certain UN Regulations contain provisions to allow for local divergence from the uniform requirements they present. The draft Revision 3 of the 1958 Agreement refers categorically to these “special provisions”. Since such provisions work against the principles of harmonization and mutual recognition of approvals, the IWVTA informal group proposes to clarify that the 1958 Agreement recognizes such provisions as existed prior to Revision 3 without institutionalizing the recourse to such deviations as a regular part of the UN regulatory process.

Schedule 4 of the draft revision 3 of the 1958 Agreement concerns the type approval numbering system for UN approvals. The numbering example reads: E11*83R03/00J*2439*01. In its second section it contains the letter J for indicating implementing stage J of UN Regulation 83. According to Schedule 4, point 2, under ©, that letter J should be preceded by a slash; however that slash is missing in the given example. It is suggested to correct this typing error by replacing the relevant example by the following example: E11*83R03/00/J*2439*01.

The International Whole Vehicle Type Approval system under development proposes to allow for the acceptance by Contracting Parties of approvals issued according to versions of a regulation earlier than the latest version in force as well as of approvals issued under some, but not all, regulations that comprise the IWVTA. This document proposes an approach to manage the various configurations of the Limited IWVTA.

Proposal to amend the paragraph concerning the modification of a vehicle type and extension or modification of approval.

OICA input concerning the proposed concept for “versions” of UN Regulations for use within the global system for the mutual recognition of type approvals. A version involves the possibility for issuance of new approvals to previous forms of a given regulation (as opposed to the current system where parties can only issue new approvals to the latest version in force of a regulation).
