Working draft prepared pursuant to discussion through the 18th SG58 subgroup session. Basis for discussions at the 19th subgroup session.

This document is the draft revision to the existing guidelines document WP29/1044/Rev.1 which includes the changes discussed at the 18th SG58 meeting and will be used as a base document for discussion at the 19th SG58 meeting.

It also includes:
1. OICA responses/comments to the proposals and comments made by the EC (see SG58-18-08)
2. OICA proposal to revise §43, as requested at the November 2015 meeting (see SG58-19-01, Action item 6)
3. Revision to the transitional provisions in chapters B (equipment and parts), C (installation of equipment and parts), D (replacement parts for vehicles in use), jointly developed with CLEPA
4. Some further proposals by CLEPA, that can be supported by OICA

Consolidated version of the working draft amendment to WP29/1044/Rev.1, incorporating changes agreed during the 18th subgroup session and the following:

Input from the WP.29 secretariat for the text explaining the meaning of a “revision” to a UN Regulation and of a “version” of a UN Regulation.

Response of the UN Office of Legal Affairs concerning the application of the proposed new revision of the Agreement to type approvals issued under the previous revision. The OLA offers an unofficial response categorically stating that the Contracting Parties determine the application of the Agreement and that unless otherwise stated, the new revision applies to approvals issued after the date that the new revision enters into force.

Proposal to delete provisions concerning Technical Services (Schedule 2). Germany cannot support the introduction of these provisions because they would conflict with the European Commission proposal of 27 January 2016 to replace Directive 2007/46/EC and tighten EU legislation on the type approval of vehicles, especially with regard to the role of the Technical Services and the related requirements to assess the quality of Technical Services. Germany proposes modifications to the draft text that still envision the introduction of a new Schedule 2 at a later stage while noting that document ECE/TRANS/WP.29/1059 would continue to govern Technical Services as a separate document until that time.
