45. The expert from EC introduced GRSP-63-31, which provides an overview of the recently adopted Revision of the General Safety Regulation and Pedestrian Safety Regulation of the European Union. He explained that among the most important items addressed by the revision, of concern to GRSP, was the extension of the pedestrian vehicle test zone to include windscreen area. He said that the adopted revision would be followed‑up by proposals to GRSP to align the UN Regulations under its responsibility.

The expert from EC introduced GRRF-83-19 reporting on the status of the review of the General Safety and Pedestrian Safety Regulations proposing a number of measures that could be implemented and for which some activities could be launched at GRRF. Given the timelines envisaged, the Chair recommended to already start addressing certain measures such as AEBS as discussed under agenda item 2.

44. The expert from EC gave a presentation (GRSP-60-21), to inform GRSP about the draft revision of the General Safety Regulation (EC) No 661/2009 of the European Parliament and of the Council. GRSP noted that many of the items listed in the review of the General Safety Regulation coincide with those priorities of work administer by WP.29 under the Agreements it administers (including the 1998 Agreement). The expert from EC confirmed the importance to continue consultation with main stakeholders to ensure consistency with common work goals.

FIA comments on data privacy provisions under UN Regulations including remarks concerning the work of the informal groups on automated driving (ITS/AD), automatic emergency calls systems (AECS), and automatically commanded steering functions (ACSF). The presentation covers issues such as protection of personal data, aggregation of data to protect individual identities, protection against unauthorized access (hacking), and prohibition against data use for purposes other than those specifically intended by a regulation. FIA proposes the deletion of data storage (DSSA) provisions under the draft texts for ACSF.

57. The expert from FIA presented GRRF-82-07 on data privacy and cybersecurity of (partly) automated driving and on Data Storage Systems for ACSF (DSSA). He advocated against potential DSSA installation requirements for data protection and cybersecurity reasons as, to date, no clarity would be provided on consumer protective measures. He stated that such systems could facilitate the collection (also over-the-air, outside of the vehicle) and interpretation of a large amount of data, that could easily be used against the driver, in various situations (e.g. for commercial, warranty, recall and liability purposes). He urged therefore GRRF to ban such systems as long as no fair and balanced relations among stakeholders would be guaranteed.

66. Referring to GRSG-108-34, the expert from UK underlined the need to develop a harmonized regulation on data recording for automated vehicles and suggested inserting a new item to the agenda of the 109th session of GRSG. He volunteered to prepare a concrete proposal on this subject. GRSG welcomed and endorsed the suggestion. Following the discussion, the Chair announced his intention to inform WP.29 and its Subgroup on Intelligent Transport System / Automated Driving (ITS/AD) about this future activity by GRSG and to coordinate the work on automated vehicles within the subsidiary Working Parties. GRSG expected to receive guidance from ITS/AD on the need for a new regulation on EDR and the extent of its content.
