OICA and CLEPA submitted the proposal for amendments of Article 3 of the 58 Agreement. They requested to clearly spell out in the 58 Agreement that ECE type approvals granted to components and vehicle systems shall be mutually recognized without any further testing or administrative procedures.

EC stated that the above-mentioned mutual recognition provision should cover not only components and vehicle systems but also whole vehicles and indicated the necessity to refer to Article 12.

OICA agreed to amend the phrase in accordance with EC’s suggestion.

Russia asked the meaning of “without any further testing or administrative procedures”.

CLEPA responded it meant “without any further testing or approval procedures based on its own national technical regulations”.

Russia pointed out the necessity to define “administrative procedures”.

OICA proposed that manufacturers should not be required to submit any other documents or data than those stipulated by ECE regulations.

Japan asked whether translation of approval certificates falls on “administrative procedures” or not. Japan requested to limit the range of “administrative procedures” to be avoided.

OICA responded that it saw no problems with translation. OICA would review the wording “administrative procedures” and make clear its intention to amend Article 3.

Japan pointed out that the phrase “for the placing on their markets” might imply the issue to be beyond type approval.

OICA had a different opinion.

ETRTO added that the phrase “for the placing on their markets” normally appears in European laws and it simply means the provisions would not be applied to a stock of products to be exported. ETRTO also showed its wish to avoid any testing or approval procedures based on respective national technical regulations.

EC stated that minimal request necessary for each country to accept ECE type approval should be reserved. EC proposed to amend the wording to be “without requiring any further testing, documentations, or certification relating type approvals”.

Russia stated that it would check the amended wording by the next IWVTA Informal meeting.

EC pointed out that it would also be necessary to discuss Article 12.

The Chairman requested OICA and CLEPA to amend Article 3 based on the discussion above and send them to Technical Secretary. The amended version would be discussed again at the next IWVTA Informal meeting.
