81. The secretary of the Working Party on Road Safety (WP.1) informed World Forum about the results of the September 2010 session of WP.1 (ECE/TRANS/WP.1/129) regarding the future development of the Agreement (ECE/TRANS/WP.29/2010/72). The representative of the Russian Federation recalled that the European Agreement of 1971 supplementing the Vienna Convention imposes the obligation of the driver to carry a valid International Technical Inspection Certificate. He underlined the current absence of international requirements establishing a list of components or elements to be checked to ensure vehicle safety and setting out the methods to be used during periodic inspections and importance of draft Rule No. 2 implemented by the World Forum. He informed the World Forum about his intention to present a proposal for consideration at the next session of WP.1 in March 2011. The World Forum considered inappropriate, for the time being, that the secretariat send a letter to the signatories to the Agreement recommending their accession.
82. Regarding Draft Rule No. 2 (ECE/TRANS/WP.29/2009/135), the World Forum noted that GRE and GRSG had considered the draft and that GRSP and GRRF would consider it at their next sessions in December 2010 and February 2011 respectively. The World Forum agreed to have, on the basis of the comments received, a final review of the proposal at its March 2011 session.
83. The World Forum noted the offer by the International Motor Vehicle Inspection Committee (CITA) to continue its cooperation for the development of the 1997 Agreement, in particular for the updating of Rule No. 1 to the same level as the corresponding EU Directive.
39. The GRSG Vice-Chair informed the World Forum about the results made by GRSG during its ninety-ninth session (for more details see the report of the session ECE/TRANS/WP.29/GRSG/78).
40. He reported that GRSG had proposed to set up, subject to the consent of the World Forum, an informal group, chaired by Germany, to amend Regulation No. 43 with regard to plastic glazing. He added that the expert from OICA had volunteered to provide secretariat services for this group. The informal group should conclude its tasks by April 2013. The World Forum gave its consent, subject to the approval, at its March 2011 session, of the terms of reference and rules of procedure of the informal group, which would be annexed to the report of GRSG.
41. He reported that GRSG had been informed about the GRE request to take on the responsibility of Regulations Nos. 60 and 121. GRSG was of the opinion that they should remain under its responsibility because these Regulations were transversal and that GRSG was already dealing with tell-tales for motorcycles and the field of vision of the driver. He mentioned that GRSG had agreed that a procedure should be set up to ensure good cooperation between the different WP.29 Working Parties. The World Forum confirmed that a decision on this issue would be taken at its March 2011 session (see para. 35 above).
42. WP.29 noted that GRSG had agreed with the proposal for draft Rule No. 2 (ECE/TRANS/WP.29/2009/135) as well as with the proposal for guidelines on establishing requirements for high-priority warning signals by the co-Chairs of the ITS informal group (WP.29-150-22).
43. The Vice-Chair informed WP.29 about the opinion of GRSG that there was no urgency to adopt the proposal (ECE/TRANS/WP.29/2009/123 and its Corrigenda 1 to 4, superseded by ECE/TRANS/WP.29/2010/145) for the revision of the Consolidated Resolution on the Construction of Vehicles (R.E.3). The World Forum recalled its decision to continue consideration of this matter under agenda item 8.7 (see paras. 36 and 91 of this report).
44. The World Forum noted that Mr. Erario (Italy) had been re-elected as GRSG Chair and Mr. Matolcsy (Hungary) as GRSG Vice-Chair for the 2011 sessions.

69. It was recalled that the World Forum had agreed to transmit the proposal (ECE/TRANS/WP.29/2009/135) to the Administrative Committee (AC.4) at its June 2011 session (ECE/TRANS/WP.29/1089, para. 74).
117. Submitted to consideration and vote, the proposed UN Rule No. 2 (ECE/TRANS/WP.29/2009/135) was adopted on 23 June 2011 by consensus vote of the following Contracting Parties present and voting:
Belarus, Estonia, Finland, Hungary, Netherlands, Romania, Russian Federation and Ukraine.
118. The representative of Belarus welcomed the adoption of the UN Rule No. 2 underlying its importance for road traffic safety and stated the effort of its country to enforce the UN Rule the fastest possible. AC.4 expressed appreciation for the contribution of Belarus to the activities of the Agreement and encouraged its active participation to those of the 1958 and 1998 Agreements because of its important role played in the field of vehicle safety.

The World Forum agreed to defer discussion on the way forward to update the Rules, to its November 2012 session, awaiting the participation of more Contracting Parties to the Agreement at that session and a common position among Custom Union countries (Belarus, Kazakhstan and the Russian Federation).

The representative of the Russian Federation introduced WP.29-158-18 proposing, in cooperation with the representative of CITA, a road map as a way forward to update the UN Rules annexed to the 1997 Agreement. He also introduced another joint proposal (WP.29-158-21) for amendments to UN Rule No. 2 (Roadworthiness) that would reduce differences with the corresponding EU Directives. On the request of the representatives of the Netherlands and Finland, WP.29 agreed to remove the O1 category of vehicles from WP.29-158-18 and WP.29-158-21, thus keeping them in line with the ongoing update of the above-mentioned Directives. Accordingly, it was agreed to resume consideration of the road map (WP.29-158-18) on the basis of a revised document with a less challenging timeline and a focus on vehicles, equipment and parts currently covered by UN Regulations. Finally, WP.29 agreed to refer WP.29-158-21 to its subsidiary bodies (GRE, GRSP, GRRF and GRSG) for detailed consideration at their next sessions.

36. The Chair recalled that ECE/TRANS/WP.29/2013/32, dealing with the update of the Rule No. 2, was referred to GRRF and the other subsidiary bodies of WP.29 for detailed consideration. The expert from the Russian Federation introduced ECE/TRANS/WP.29/2013/32 proposing to harmonize Rule No. 2 with the provisions set in the European Union Directive 2010/48/EC and asked for comments. Some experts noted that the corresponding European Union Directive was still under consideration for amendments. GRRF preferred to wait for the completion of this work to avoid a further update of Rule No. 2.

The World Forum adopted WP.29-159-10 as reproduced in Annex II to the report. The representative of the Russian Federation presented WP.29-159-13 proposing amendments to Rule No. 1 (Environment protection) to harmonize the provisions with those of the latest UN Regulations annexed to the 1958 Agreement and the EU Directives. WP.29 agreed to refer WP.29-159-13, with an official symbol, to its subsidiary Working Parties for detailed consideration at their next sessions.
74. Referring to ECE/TRANS/WP.29/2013/32, WP.29 noted that the GRs were in the process of revising the proposal for amendments to UN Rule No. 2.

63. The representatives of Estonia, Finland, Hungary, the Netherlands and Romania noted the parallel development of amendments to the UN Rules annexed to the 1997 Agreement and the corresponding EU Directive. They requested to delay (WP.29-162-09) the submission of the proposed amendments to UN Rules Nos. 1 and 2 (ECE/TRANS/WP.29/2013/132 and ECE/TRANS/WP.29/2013/133) to the Administrative Committee of the 1997 Agreement (AC.4), making sure that their obligations would not conflict with the EU Directive. Theye stated that if the amendments to UN Rules Nos. 1 and 2 are adopted, they would not be harmonized with the current EU Directive. The Chair of GRRF recalled the discussion outcome at GRRF that the most pragmatic approach would be to consider aligning the amendments to the 1997 Agreement and the EU Directive as much as possible as these activities were progressing nearly in parallel.
64. The representative of the Russian Federation noted that WP.29 at its 156th session (ECE/TRANS/WP.29/1095, para 84) had confirmed the importance of Periodical Technical Inspection (PTI) of vehicles for road safety and had agreed to extend the scope of UN Rules Nos. 1 and 2 to cover vehicles of categories M1, N1 and O1 making the 1997 Agreement more useful for emerging economies and for those countries not having a PTI system. He added that, accordingly, WP.29 had agreed to defer to a later stage the alignment of the provisions of both UN Rules to the corresponding EU Directive. He expressed the wish that the submission of the proposal for amendments to UN Rules Nos. 1 and 2 should not be further delayed, given the safety and environmental implications of these amendments.
65. After examination with the Contracting Parties present, WP.29 saw no possibility to organize the vote on the amendments to the UN Rules and recommended not to hold the AC.4 session.

70. The representative of the Russian Federation introduced WP.29-163-17, containing amendments to the proposed amendments to UN Rules 1 and 2 (ECE/TRANS/WP.29/2013/132 and ECE/TRANS/WP.29/2013/133). WP.29 agreed on a detailed discussion of WP.29-163-17 at its next session in November 2014 and requested the secretariat to distribute it with an official symbol. The representative of CITA was invited to prepare a document with the differences between the proposals for amendments to UN Rules Nos. 1 and 2, as modified by WP.29-163-17, and the recently adopted EU Directive (2014/45/EU) on this matter. The representatives of Finland and the Netherlands expressed their preference for aligning the date of entry into force of both the EU Directive and the draft amendments to UN Rules Nos. 1 and 2. The Vice-Chair proposed to investigate the use of transitional provisions addressing the comment expressed above.

Theye stated that if the amendments to UN Rules Nos. 1 and 2 are adopted, they would not be harmonized with the current EU Directive. The Chair of GRRF recalled the discussion outcome at GRRF that the most pragmatic approach would be to consider aligning the amendments to the 1997 Agreement and the EU Directive as much as possible as these activities were progressing nearly in parallel.
64. The representative of the Russian Federation noted that WP.29 at its 156th session (ECE/TRANS/WP.29/1095, para 84) had confirmed the importance of Periodical Technical Inspection (PTI) of vehicles for road safety and had agreed to extend the scope of UN Rules Nos. 1 and 2 to cover vehicles of categories M1, N1 and O1 making the 1997 Agreement more useful for emerging economies and for those countries not having a PTI system. He added that, accordingly, WP.29 had agreed to defer to a later stage the alignment of the provisions of both UN Rules to the corresponding EU Directive. He expressed the wish that the submission of the proposal for amendments to UN Rules Nos. 1 and 2 should not be further delayed, given the safety and environmental implications of these amendments.
65. After examination with the Contracting Parties present, WP.29 saw no possibility to organize the vote on the amendments to the UN Rules and recommended not to hold the AC.4 session.

70. The representative of the Russian Federation introduced WP.29-163-17, containing amendments to the proposed amendments to UN Rules 1 and 2 (ECE/TRANS/WP.29/2013/132 and ECE/TRANS/WP.29/2013/133). WP.29 agreed on a detailed discussion of WP.29-163-17 at its next session in November 2014 and requested the secretariat to distribute it with an official symbol. The representative of CITA was invited to prepare a document with the differences between the proposals for amendments to UN Rules Nos. 1 and 2, as modified by WP.29-163-17, and the recently adopted EU Directive (2014/45/EU) on this matter. The representatives of Finland and the Netherlands expressed their preference for aligning the date of entry into force of both the EU Directive and the draft amendments to UN Rules Nos. 1 and 2. The Vice-Chair proposed to investigate the use of transitional provisions addressing the comment expressed above.

He noted that the documents were harmonized with the provisions of the latest Regulations, annexed to the 1958 Agreement, and harmonized with the European Directive 2014/45/EU, Customs Union Regulation and other national legislations.
73. He explained that to ease the conditions for accession to the 1997 Agreement by the majority of Member States of the United Nations, the group proposed to exclude M1 and N1 vehicle categories from the scope of the Rules.
74. He, however, recalled that WP.29 at its 156th session (ECE/TRANS/WP.29/1095, para 84), had decided to extend the scope of the UN Rules to M1 and N1 vehicle categories, which had been reconfirmed at its 162nd session (ECE/TRANS/WP.29/1108) and that the corresponding draft amendments (ECE/TRANS/WP.29/2013/132/Rev.1 and ECE/TRANS/WP.29/2013/133/Rev.1) had been developed by the Russian Federation and CITA. He noted that a limited number of the Contracting Parties attended IWG on PTI and asked, therefore, for guidance by WP.29 on the subject.
75. The representative of Finland proposed to keep M1 and N1 vehicle categories in the scope of the Rules.
76. The representative from Hungary confirmed that for his country UN Rules covering M1 and N1 vehicle categories, harmonized with EU legislation, would be necessary.
77. WP.29 requested the IWG on PTI to continue the work on revising UN Rules Nos. 1 and 2 and to submit draft amendments, covering both M1 and N1 vehicle categories for the next session.

The representative of CITA introduced informal document ITC (2015) No. 15, proposing the development of three additional rules to the 1997 Agreement: (i) requirements on the roadworthiness facilities and test equipment, (ii) requirements on the competence, training and certification of inspectors, and (iii) supervising bodies.
81. The representative of the Netherlands stated that his country agreed with the proposal from CITA and the secretariat to create an IWG. He expressed the willingness of his country to chair it.
82. The representative of Finland welcomed the initiatives and supported the proposal. He expressed the willingness of his country to participate in the work of the group.
83. The representative of Sweden stated that, as a Member State of the EU, his country was obliged to transpose EU directives. He stated that it would be interesting to learn more about the 1997 Agreement to assess if this would be a suitable platform to develop PTI Rules. He added that, as the 1968 Vienna Convention links the usage of vehicles with PTI, the 1997 Agreement could become a cooperation platform between WP.29 and WP.1. He expressed his support for the establishment of an IWG.
84. The representative of Romania supported the establishment of the IWG and expressed the hope that this proposal would address the challenges faced by WP.29 and AC.4.

97. The representative of the European Union, on behalf of the Chair of the IWG on DETA, presented informal document WP.29-176-23. He mentioned that the expert from CITA offered to fund the development of the Declaration of Conformance (DoC) functionality in DETA as it may offer a platform for exchanging information about permissible vehicle software (including version numbers and integrity validation data) for various use cases and stakeholders including PTI and also for providing type approval information for the benefit of the PTI process as stated in WP.29-176-18.
98. The representative of OICA stated the highly confidential nature of documents stored in DETA and highlighted the need to create access rights that would respect their intellectual property and confidentiality. He proposed that WP.29 clarify who would be able to access the documents in DETA. The representative of Germany offered that IWG on DETA explore the possibility to organize a WebEx meeting to work on this issue and proposed that only type approval authorities should have access to the DETA, in a first stage.
99. The representative of France sought clarification whether the starting date for the use of DETA in its productive phase is meant to have an optional or mandatory nature.
100. The representative of Tunisia highlighted the importance to have secured and reliable access to trustworthy type approval documentation in the shortest time frame possible to allow the verification of authenticity of type approval documentation.
101. The representative of Spain requested further information on the status of the availability of a manual detailing the protocol to access and use DETA.
102. The representative from EuroMed mentioned that access to DETA was critical for all EuroMed countries and requested information on the ways to access to DETA.
103. The representative of Global NCAP explained, as an example, that South American countries envisaged applying United Nations regulations as an interim measure until they potentially accede to the 1958, 1997 and 1998 Agreements. He stated that these countries, not yet contracting party to the agreements would need access to DETA and that it might accelerate the adhesion process.
104. The secretariat invited the heads of delegations to provide the secretariat with the Single Point Of Contact (SPOC) on the designation of type approval authorities and technical services that would receive credentials for accessing the application for introducing new or changes to existing information.
105. The representative from CITA introduced a proposal for a next evolution of DETA by presenting WP.29-176-18 on individual vehicle specific information on permissible vehicle software. This would support the process of Periodic Technical Inspection (PTI) of modern vehicles, which is an important factor for road safety.
106. CITA confirmed its financial contribution for the development of the Document of Conformity (DoC) module of DETA without any preconditions.
107. The representative of the United Kingdom expressed, in principal, his agreement to the availability of software information (RxSWIN) for the purpose of PTI, nevertheless, questions on confidentiality and data security need to be solved first.
108. The representative of OICA recalled ongoing work in the Task Force on Cyber security, where software information is handled as software identifier RxSWIN, and introduced as part of the type approval certificate.
108 bis. The representative from the Netherlands supported this. The WP.29 Chair expressed the need for coordination between the Task Force on Cyber Security and the IWG on DETA on this issue.
109. Addressed by the WP.29 Chair on financial contributions to the further development of DATA for the module of the Unique Identifier (UI): - CLEPA stated that a budget had been reserved and awaited the outcome of Executive Committee (EXCOM) discussions on the ECE budget proposal, an anticipated funding was envisaged for 2019;
- ETRTO confirmed its commitment to contribute to funding UI; and
- OICA reiterated their willingness to contribute to developing UI, if CLEPA, ETRTO and other stakeholders would do so.
