Agreement 1: A CP can start “applying” a Regulation based on an older version.

Agreement 2: A CP “applying” a Regulation based on an older version shall accept type approvals based on any later versions of the Regulation including the latest one,

Agreement 3: In principle earlier versions of Regulations will not be subject to further changes through supplements or corrigenda. However, changes to these earlier versions can be made if the changes are inevitable and have legitimate reasons. [This need not to be addressed in the revised 1958 Agreement]

Outstanding issue 1: Can a CP “applying a Regulation based on an older version issue type approvals based on any later versions including the latest one provided the CP has competence?

Outstanding issue 2: Can a CP “applying a Regulation based on an older version vote future amendments to the Regulation?

Action item 1: All CPs and NGOs attending Sub-group meeting must submit comments on outstanding issues 1 and 2 above by October 15.

Action item 2: Submit comments on “the preliminary drafting proposals to reflect the principles illustrated in the examples in points 1 and 2” in document IWVTA-SG58-02-02 by October 15.

Action item 3: Submit comments on the following approach concerning Agreement 3 above by October 15, if any.

- The provision “In principle earlier versions of Regulations will not be subject to further changes through supplements or corrigenda. However, changes of these earlier versions can be made if the changes are inevitable and have legitimate reasons” (wording to be reviewed) should be incorporated in the guidance document WP.29/1044/Rev.XX. This need not to be addressed in the revised 1958 Agreement.

Action item 4: Japan will ask ASEAN countries on their stance concerning outstanding issues 1 and 2 above (or concrete proposal as a package to be agreed by IWVTA Informal Group in November) by the end of December at the latest.
