Agreement 1: Agreement 3 of the 2nd Sub-group meeting should be amended as follows; “In principle earlier versions of Regulations will not be subject to further changes through supplements or corrigenda. However, changes of these earlier versions can be made if the changes are inevitable and have legitimate reasons. [This needs not to be addressed in the revised 1958 Agreement]
Agreement 2: The definition of “apply a Regulation” indicated below should be inserted in the appropriate article (article 1.4.2 seems appropriate) of the 1958 Agreement.
If a CP applies a Regulation, that CP:
(1) can issue a type approval based on the latest versions of the Regulation;
(2) can issue a type approval based on any of the earlier versions of the Regulation, however no CPs are obliged to accept such type approvals;
(3) shall accept a type approval based on the latest versions of the Regulation.
(4) has a right to participate in the voting in the future amendment of the Regulation;
(Outstanding issues 1 & 2 of the 2nd Sub-group meeting will be resolved by this definition of “apply a Regulation”.)
Action item 1: Japan will ask the stance of ASEAN countries on the above definition of “apply a Regulation” by the end of December.
