96. The representative of the Russian Federation reported on the results of market surveillance of trucks with regard to their external noise (WP.29-197-11). He pointed out that pass-by noise tests of N3G trucks approved pursuant to UN Regulation No. 51, 02 series of amendments, had revealed vehicles that did not comply with the requirements of that Regulation. According to him, the Russian authorities had discovered tampering with the onboard electronic system which artificially prevented the engine from accelerating to the required rated speed 1’900 rpm in the fifth gear, in order to not to exceed the established sound level. However, testing at higher gears, where no electronic restrictions were imposed, had demonstrated sound levels above the limit. The representative of the Russian Federation felt that the test procedure in UN Regulation No. 51, 02 series of amendments, should be modified in order to avoid similar situations in the future. 97. WP.29 took note of this information and invited the Russian Federation to submit a detailed technical report to the next session of GRBP for consideration and action, as appropriate. 98. The representative of the Russian Federation recalled that, at the previous session, he had reported on cases of non-compliance of trucks approved in Spain pursuant to UN Regulations Nos. 51, 58, 73 and 121, which had been notified to the competent Spanish authorities. He noted that no reply had been received so far from the Spanish colleagues. With reference to the provisions of Article 4 of the 1958 Agreement, he pointed out that until the situation would have been clarified, the Russian Federation would not accept vehicle type approvals granted in Spain for those manufacturers whose products had been found to be non-compliant with the above UN Regulations (WP.29-197-10). 99. The representative of Spain reported on the measures undertaken by the competent Spanish authorities in response to the notification of the Russian authorities, including analysis of type approval and Conformity of Production (CoP) documentation and ad-hoc physical CoP audit in the OEM headquarters in October 2025 on noise level, rear protection and side protection (WP.29-197-26). According to him, the results of these measures did not provide sufficient justification for withdrawal of the granted type approvals. He also added that regular audits would continue in the future. The representative of the Russian Federation invited the Spanish authorities to provide an official reply to their notification. 100. WP.29 thanked both countries for their inputs and invited the competent authorities of Spain and the Russian Federation to continue cooperation on the reported cases in order to restore the product compliance. |
