Alignment of Regulation No. 96 to EU Stage V
Document Title: Alignment of Regulation No. 96 to EU Stage V
|
Document Reference Number: GRPE-74-13
|
Description: Regulation (EU) 2016/1628, also known as the NRMM Regulation or Stage V Regulation, restructures the EU regulation of non-road mobile machinery ranging from lawn mowers to snow mobiles to bulldozers, but excludes agricultural machinery (to be subjected to a separate EU regulation). In order to maintain the alignment between UN Regulations on emissions and EU emissions regulations, the EC proposes GRPE work on a new series of amendments to UN R96 (and by extension UN R120) for publication in 2018.

20. The expert from EC presented a status report on the WLTP Task Force dealing with the transposition of WLTP into the 1958 Agreement (GRPE-74-20). He informed that the Task Force had not met yet, but the first meeting would take place in February 2017. For the [adaptation] of the 1958 Agreement to include WLTP, he explained the intention was to follow a two-step approach: first, introduction of transitional provisions in Regulations Nos. 83 and 101 (see paras. 11-13 above); second, full transposition of GTR No. 15 into new Regulations under the 1958 Agreement. He recalled previous presentations by EC and the Secretariat on possible ways to structure these new Regulations (GRPE-72-18 and GRPE-73-26).
21. GRPE agreed to further discuss the transposition of WLTP into the 1958 Agreement at the next GRPE session on the basis of the work carried out by the WLTP Task Force dealing with this topic.

17. The expert from EC briefed GRB on preparing a new EU Regulation aimed to amend and supplement the Acoustic Vehicle Alerting System (AVAS) requirements in Annex VIII to EU Regulation No. 540/2014, based on the provisions of Regulation No. 138 and its 01 series of amendments (GRB-65-05). GRB noted the legal complications stemming from the fact that the so-called AVAS ‘pause switch’ was mandatory in EU Regulation No. 540/2014, optional in the original version of Regulation No. 138 and then prohibited in its 01 series of amendments.

14. The expert from EC introduced draft amendments on powered cycles (GRB-65-09), including definitions of new subcategories L1-A and L1-B, with a view to aligning Regulation No. 63 with the EU legislation. The experts from Germany and the Netherlands pointed out that the overwhelming majority of powered cycles were electric and questioned the need for the proposed amendments. The expert of Japan called for a prudent approach when and if introducing new categories of vehicles, because other Regulations might be affected as well. GRB was of the view that more time would be needed to study the proposal and invited the expert from EC to issue it as an official document for the next session.

21. The experts from EC informed GRB about an ongoing study on Euro 5 sound level limits of L-category vehicles (GRB-65-16 and Add.1), with the aim to investigate the potential for lower limits and to prepare justified proposals for amendments to EU Regulation No. 168/2013 and, at a later stage, to UN Regulations Nos. 9, 41 and 63. According to the experts, the study had been launched in response to frequent complaints from citizens over the excessive levels of sound emissions from L-category vehicles, which were often perceived as disturbing and harmful noise for the public health.
22. The experts of Germany, Netherlands, IMMA and OICA pointed out that the underlying problems were not because of the prescribed limits for new vehicles, but due to retrofitting and tampering with silencers of the vehicles in use. Thus, these experts were of the view that only reducing the sound level limits in the above Regulations would not improve the situation, unless accompanied by efficient enforcement measures and market surveillance. GRB agreed to study the relevant documents and to monitor the developments at the EU level.

GRE was informed that WP.29, at its November 2016 session, had requested GRE, in cooperation with IWG on IWVTA, to clarify the individual Regulations on lighting and light-signalling devices with a requirement that light sources in these devices should be type approved pursuant to Regulations Nos. 37, 99 or 128 (ECE/TRANS/WP.29/1126, para. 62). In line with this request, the expert from EC proposed collective amendments to device Regulations and to Regulation No. 48 (ECE/TRANS/WP.29/GRE/2017/7, Informal document GRE-77-30-Rev.1). Following an in-depth discussion, GRE adopted the proposals for amendments, as laid down in Annex IV, and requested the secretariat to submit them to WP.29 and AC.1 for consideration and vote at their June 2017 sessions.

10. The Chair of GRSP, chairing also the IWG, informed GRSP about the completion of work achieved by the group and showed the main contents of the draft UN GTR (ECE/TRANS/WP.29/GRSP/2017/2) through a presentation (GRSP-61-25). He also introduced the final report of the IWG activities (GRSP-61-09). The expert from EC supplemented this presentation by introducing the main changes to the draft UN GTR (GRSP-61-08) that had been agreed upon by the IWG during its last meetings. He also introduced a clean copy of the draft UN GTR (GRSP-61-07) incorporating GRSP-61-08. Finally, GRSP recommended ECE/TRANS/WP.29/GRSP/2017/2, as amended by Annex II to this report, and the final report of the IWG (GRSP-61-09) as reproduced in Annex II to this report, for their establishment in the global registry. The secretariat was requested to submit the proposal and the final report to WP.29 and to the Executive Committee of the 1998 Agreement (AC.3) for consideration and vote at their November 2017 sessions as a new UN GTR on Electric Vehicle Safety.
11. The expert from EC expected that UN Regulation No. 100 would be amended as a new series of amendments to facilitate the transposition of the UN GTR into national legislation the Chair of GRSP clarified that the United States of America intends to follow the UN GTR adoption process as required under the 1998 Agreement on the issue of the transposition plan of the UN GTR into domestic legislations, He also expressed that currently there is a lack of safety provisions on Lithium Ion battery in his country. The expert from the China informed GRSP that his country plans to transpose the UN GTR gradually due to its complexity. The Chair of GRSP recommended that the transposition of the UN GTR should be as much as possible consistent with the actual text of the UN GTR. The Chair of GRSP informed GRSP that the IWG of phase 2 of the UN GTR would start, without discontinuation, to address thermal propagation and other pending technical issues. Accordingly, GRSP noted that a draft authorization to develop Phase 2 of the UN GTR is expected to be submitted to AC.3 and WP.29 at the November 2017 sessions. Finally, GRSP agreed to resume discussion at its December 2017 pending on AC.3 decision.

33. The expert from EC reiterated the importance of the Unique Identifier (UI) and DETA for the simplified lighting and light-signalling Regulations (GRE-77-31). According to him, the grouping of a number of devices into a single Regulation is not compatible with the traditional approach of using one marking per series of amendments to the Regulation. Thus, he argued in favour of mandatory, rather than optional, use of UI. GRE concurred with his view, but noted that the use of UI is conditional upon the availability of DETA. The expert of GTB also pointed out the unclear interpretation of Schedule 5 to the Revised 1958 Agreement with regard to the obligatory use of UI and DETA.

142. The representative of the United States of America, on behalf of the Chair of the IWG on EVS, informed AC.3 that GRSP had recommended submission to the November 2017 session of AC.3, of the draft UN GTR WP.29-172-06 and of the final report of the IWG (WP.29-172-05). AC.3 noted the intention of the IWG to continue its activity by already starting the work on Phase 2 until the end of its mandate in December 2017. AC.3 agreed in principle with the request, pending: (a) an official authorization to develop the work of Phase 2 of the UN GTR for submission to the November 2017 session of AC.3, and (b) the Term of Reference of the IWG for the Phase 2 for submission at a later stage. AC.3 noted that this approach would avoid the discontinuation of IWG work activities and deal with the urgent, pending issues from Phase 1 of the UN GTR (WP.29-172-06).

24. The expert from EC informed GRB about the EU activities that aim to prevent or reduce the effects of exposure to environmental noise harmful for health (GRB-66-18). According to the expert, this work is conducted in the framework of Directive 2002/49/EC which inter alia provides for a road vehicle (acoustic) classification and a road surface (acoustic) classification. To allow detailed discussions with member States and stakeholders on environmental noise policy issues, the EU Noise Expert Group (NEG) had been established. The expert wondered if there was space for exchange of information between GRB and NEG. The Chair was of the view that GRB and NEG should identify common elements for future cooperation.

39. The expert from OICA introduced GRSP-62-14, as an alternative proposal to ECE/TRANS/WP.29/GRSP/2017/27 tabled by the expert from EC, concerning the information in the airbag warning label on the correct installation of CRS on a passenger seat with an activated frontal airbag. He suggested that the proposal should be adopted as a new series of amendments to UN Regulation No. 16 (Safety-belts) instead of a Supplement and to regroup these kind of requirements in UN Regulation No. 16 only. He also underlined the problem of translation in all languages of the detailed information, which makes reference to the warning, that should be contained in the owner’s manual.
40. The expert from Australia explained that his country requires vehicles to be fitted with an airbag warning label through a national rule that requires vehicles to meet UN Regulation No. 94. He added that although his country also had a national rule that incorporates UN Regulation No. 16, this rule does not require vehicles to meet the airbag warning label requirements of UN Regulation No. 16. Therefore, he stated that removing the requirement for an airbag warning label from UN Regulation No. 94 would create a loophole, which would allow vehicles to be supplied to the Australian market without any airbag warning label.
41. GRSP agreed to resume discussion on this subject at its May 2018 session. The secretariat was requested to distribute GRSP-62-14 with an official symbol at the next session awaiting a possible revised proposal submitted by the expert from OICA.

42. The expert from EC introduced GRSP-63-01-Rev.1, amending ECE/TRANS/WP.29/GRSP/2017/27 on the information of the airbag warning label about correctly installing CRS on a passenger seat with an activated frontal airbag. GRSP noted that the proposal also incorporated GRSP-63-01-Rev.1 (see para. 18 above). GRSP adopted ECE/TRANS/WP.29/GRSP/2017/27, as amended by Annex X to the session report. The secretariat was requested to submit the proposal for consideration and vote at the November 2018 sessions of WP.29 and AC.1 as: - Draft 08 series of amendments to UN Regulation No. 16
- Draft Supplement 15 to the 04 series of amendments to UN Regulation No. 44
