Proposal to align ASEP for high powered L4 and L5 vehicles, used for passenger transport, is proposed in line with UN Regulation No 41.04 due to comparable sound emissions levels of L4 and L5 vehicles with the ones of L3 vehicles and the possibility of applying similar measurement methods for sound emissions for those vehicle categories. This is also supported by the Commission study on enhanced sound requirements for mopeds, quads and replacement silencers of L-category vehicles which resulted in amendments to UN Regulation Nos 9, 63 and 92 (ref. document WP.29/2017/2).

28. The expert from EC presented updated amendments for a new series of amendments to Regulation No. 9 with the aim to introduce ASEP requirements for L4 and L5 category vehicles with the power-to-mass ratio (PMR) of more than 50 W/kg (GRB-67-04). The expert of IMMA was of the view that the industry would need much longer transitional periods for implementing the amendments. The secretariat pointed out that the references to standard ISO 10844 should be updated. GRB invited the expert from EC to update the proposals and submit them as an official document for consideration at the next session.

29. The expert from Germany presented an overview of issues with noise emissions of non-original replacement exhaust silencer systems (NORESS) for L-category vehicles (GRB-67-03), as well as a possible solution in the form of a Supplement 3 to the 01 series to UN Regulation No. 92 (GRB-67-02). Following a brief exchange of views, GRB generally supported the approach and agreed that the proposed modifications should become a new series of amendments. GRB experts were invited to transmit their comments, if any, directly to the expert of Germany, so that he would be able to submit an official document for consideration at the next session.

21. The experts from EC informed GRB about an ongoing study on Euro 5 sound level limits of L-category vehicles (GRB-65-16 and Add.1), with the aim to investigate the potential for lower limits and to prepare justified proposals for amendments to EU Regulation No. 168/2013 and, at a later stage, to UN Regulations Nos. 9, 41 and 63. According to the experts, the study had been launched in response to frequent complaints from citizens over the excessive levels of sound emissions from L-category vehicles, which were often perceived as disturbing and harmful noise for the public health.
22. The experts of Germany, Netherlands, IMMA and OICA pointed out that the underlying problems were not because of the prescribed limits for new vehicles, but due to retrofitting and tampering with silencers of the vehicles in use. Thus, these experts were of the view that only reducing the sound level limits in the above Regulations would not improve the situation, unless accompanied by efficient enforcement measures and market surveillance. GRB agreed to study the relevant documents and to monitor the developments at the EU level.

32. The Chair presented a revised list of possible issues for the future GRB activities compiled at the third informal meeting in July 2016 (GRB-64-08). The expert from Japan proposed modifications to the time limits of some activities listed in this document. The expert from France presented proposals to improve efficiency of road vehicle noise Regulations by tackling such issues as day-to-day and track-to-track dispersion between measurements and different interpretations of the same text (GRB-64-15). The expert from EC proposed to include three additional points related to L-category vehicles (GRB-64-17). The expert from OICA reported on a meeting between ETRTO and OICA which concluded that a harmonized test procedure for tyre and vehicle noise measurements would be beneficial for industry and environment. Finally, GRB invited all experts to submit their comments in writing to the Chair and requested the Chair to update the list accordingly.

The expert from EC informed GRB about a study on how to enhance the sound test requirements for mopeds, three-wheeled vehicles in Regulations Nos. 9, 63 and replacement exhaust silencing systems for L categories (L1 to L5) in Regulations Nos. 92 before the European Union (EU) could accept these Regulations (GRB-63-18). This study included public consultations and had been launched in response to frequent requests by citizens to improve the sound level of mopeds and three-wheeled vehicles as well as of replacement silencers for all L-category vehicles. On a similar note, the expert from EC reported about the ongoing public consultations on the EU Environmental Noise Directive1 (GRB-63-18-Add.1).
14. Based on the outcome of the study, the expert from EC proposed a set of collective amendments to Regulations Nos. 9, 63 and 92 (GRB-63-03, GRB-63-05, GRB-63-07, GRB-63-08, GRB-63-09). The experts from France, Germany, IMMA and OICA delivered a number of remarks on these documents. GRB invited all experts to transmit their written comments, if any, to the expert from EC. Finally, GRB decided to continue consideration of these amendment proposals at its next session based on official documents to be submitted by the expert from EC.

24. The Chair presented a revised list of possible issues for the future GRB activities compiled at the second informal meeting in December 2015, together with written comments by some experts (GRB-62-08-Rev.2). GRB noted that some of these issues could be addressed directly by GRB while some others might require the establishment of informal working groups (IWG). In particular, IWGs were suggested in relation to Regulations Nos. 41 and 51 for the ASEP provisions and for pass-by noise tests of vehicle in-use (during roadside checks and periodic technical inspections). The experts from France and Germany preliminarily volunteered to chair, respectively, these groups. The experts from China, Japan, Hungary, EC, IMMA and OICA expressed their support for the creation of these IWGs. GRB decided to take a decision on their establishment at its next session.
25. The expert from EC delivered a number of additional comments on GRB-62-08-Rev.2. In particular, he indicated that the ASEP provisions (in a light version) and pass-by tests were also necessary for Regulations Nos. 9 and 63, as proposed in documents GRB-63-07 and GRB-63-08. For possible new sound level limits in Regulations Nos. 9, 63, 92 and 117, as well as for re-treaded tyres, he pointed out that such limits may only be proposed after discussions with the EU member States in due time, subject to internal planning and availability of resources.
26. The expert from the Russian Federation proposed to amend the list of possible future activities, in the long term, with the following issues: infrasound and preparing a definition of quiet vehicles. The expert from ETRTO was of the view that it would be premature to address re-treaded tyres and pointed out that GRRF should also be involved in considerations of this issue.
27. GRB invited the Chair to update the list based on the comments received and decided to revert to this issue at its next session.

6. The expert from Japan suggested that references to ISO 10844:2011 be put in square brackets for the time being and requested GRB to revert to this issue at the next session.
7. The expert from OICA briefly introduced some additional elements which had been identified by IWG on UN Regulations Nos. 51 and 59 for further consideration and possible inclusion into the 03 series of amendments to UN Regulation No. 51 (GRB-60-01). The expert from ISO informed GRB about a new version of ISO 10844:2014 which added a few editorial modifications to the previous version ISO 10844:2014 without changes in the fundamental requirements (GRB-60-17). The expert from China introduced GRB-60-10-Rev.1 and GRB-60-15 in which he suggested higher limit values and a new classification for vehicles of a specific category available on the Chinese market. GRB requested the IWG on UN Regulations Nos. 51 and 59 to consider all these additional aspects and to prepare proposals for the next session, if necessary.

The expert from ETRTO referred to the ongoing work of updating references to the new version of ISO standard 10844:2014 (see para. 17 below) and proposed similar amendments to Annex 3 of Regulation No. 117 (GRB-61-14). The expert of ISO recalled his presentation on the comparison between the 2014 and 2011 versions of ISO 10844 (GRB-60-17) and confirmed that only editorial modifications had been introduced without any technical changes. Thus, GRB agreed that no transitional provisions were required in this case. GRB adopted the proposal, as contained in Annex VI to this report, and mandated the secretariat to submit it to WP.29 and AC.1 for consideration and vote at their June 2015 sessions as a draft supplement to Regulation No. 117.

Accordingly, GRB agreed to follow the layout of GRSP-51-03, considered during the May 2012 session of the Working Party on Passive Safety (GRSP), designed for this purpose. Furthermore, EU would apply UN Regulation Nos. 9 and 63 once they were aligned to UN Regulation No. 41.

Accordingly, the expert from IMMA introduced GRB-55-02 and GRB-55-03 amending respectively UN Regulation Nos. 9 and 63 proposing new requirements for improved noise control of motorcycles and anti-tampering measures (aligning to the 04 series of amendments to UN Regulation No. 41). He added that provisions for hybrid and electric vehicles would be included in a second phase of revising the two UN Regulations. The expert from Italy supported the proposals.

14. GRB agreed to defer discussion on this agenda item to its February 2012 session, awaiting a concrete proposal from the expert of the Netherlands to harmonize the terminology used in the Regulations concerned.
Definitions and acronyms in Regulations under GRB responsibilities on the basis of an initiative of the Working Party on Pollution and Energy
23. GRB was informed about the current intention of GRPE to list all definitions and acronyms currently in the Regulations on noise emissions under its responsibility to avoid misconception when used in other Regulations. In this respect it was noted that RESS acronym (Replacement Exhaust Silencing Systems) was also used by the Working Party on Passive Safety (GRSP) for Rechargeable Energy Storage Systems. GRB agreed to resume discussion at its February 2012 session on the basis of a proposal voluntarily prepared by the experts from OICA and ISO.
24. The expert from the Russian Federation introduced GRB-54-05, proposing a revision of the titles of Regulations under GRB responsibilities. The proposal received comments from GRB experts, such as to replace the word “noise” with “sound” in all the texts of Regulations. GRB agreed to resume discussion on this subject on the basis of a proposal jointly prepared by the experts from the Russian Federation and the Netherlands.
25. GRB also agreed to revise the scope of noise Regulations annexed to the 1958 Agreement, shown by categories of vehicles in the Consolidated Resolution on the Construction of Vehicles (R.E.3) with the intention to include especially L6 and L7 categories. Accordingly it was agreed to introduce a new agenda item on this subject in the agenda of the February 2012 session of GRB.
