For the 1st action item “Paragraph 14. Criteria for establishing new Regulations –write up the definitions of Alternatives and Option” OICA proposed the draft amendment of Article 12 of 58 Agreement. OICA pointed out the discrepancy between Clause 1 and 2. Clause 1 stipulates that CPs applying an earlier series of amendments or the unamended Regulation shall accept approvals granted to a later amendment series, whereas Clause 2 stipulates that the adopted amendment shall not be binding upon those CPs applying the Regulation who declared themselves opposed to it. OICA asked WP29 Secretariat for comments on the discrepancy but received no clear answer. OICA proposed to delete the latter half of Clause 2 (one-fifth votes).

Russia requested OICA to make clear that CPs applying only the most recent amendments can grant type approvals for an earlier series of amendments or the unamended Regulation.

OICA agreed and would review Article 12 in accordance with Russian request.

Japan stated that one of the mandate of IWVTA Informal Group is to make 58 Agreement attractive for emerging-market countries to join. Japan regarded it as a good proposal to make earlier series of amendments effective as an optional Regulation for emerging-market countries. Japan would consider the wording of Clause 2 of Article 12.

EC would deliberate whether to delete Clause 2 of Article 12, which is a special clause to keep previous series of amendments effective, by the next IWVTA Informal meeting. EC suggested that it would be better to consider Clause 1 and 2 separately.

OICA pointed out the necessity to consider setting different levels of technical requirements stemming from regional characteristics, if necessary. This would require a kind of matrix showing the level of requirements which respective countries apply.

The Chairman stated that another IWVTA Informal meeting must be held in order to submit at least an inventory on issues eligible for amendments of 58 Agreement to November WP29 Session. For this reason, the 7th Informal meeting will be held on September 28 (Wednesday) at 10:00 at CCFA in Paris.

The Chairman confirmed the difference between Appendix (the same as 58 Agreement text binding on all CPs) and Annex or Addendum (to be applied to only CPs who apply the said Regulations). The Chairman also noted that Appendix X (RE3 Annex7) and Appendix Y (Type approval procedures) would be newly attached to 58 Agreement. The Chairman further requested all members to review WP29/1044 and WP29/1059 (to be incorporated in the Appendix Y) precisely by the next IWVTA Informal meeting.

OICA pointed out the necessity to incorporate Annex 1 (information document) of 2007/46/EC into ECE Regulation.

The Chairman agreed on the necessity of information document.

Japan indicated the necessity to coordinate the various issues expressed at documents IWVTA-06-09, IWVTA-06-11 and IWVTA-06-12 because they have close relation one another.

The Chairman announced that the main agenda of the next IWVTA Informal meeting to be held on September 28 would be the revision of 58 Agreement. Analysis on the proposal prepared jointly by EC and Japan must be completed.
