78. The GRPE ambassador to the IWG on IWVTA and DETA introduced GRPE-87-20 and GRPE-87-21 updating GRPE on the latest information from the IWG on DETA about the implementation of the Unique Identifier (UI) in UN Regulations pertinent to GRPE. He also informed that the budget expected for 2023 to develop the UI had not been approved.
79. The representative from EUROMOT requested more time to review the need for UI in UN Regulations Nos. 96 and 120. He added that initial thinking done assumed that UI would not be able to mandate additional information. He requested to have a second look at the topic if UI could be accompanied with additional information to be read on the component, which would be needed for most engines to be fitted on non-road mobile machineries.
80. The representative from CITA showed a few examples of the impact of UI on space savings, to highlight the fact that in some cases, it would not save much space, and that this would not compensate time spent to search for the information on-line that would otherwise be readily available. He invited to re-think the configuration of UI, with the funding to develop it now being on-hold. The representative from OICA confirmed space was an issue on powertrain and also noted that several UIs could be combined.
81. The GRPE ambassador to the IWG on IWVTA and DETA agreed UI noted there might be advantages to OEMs to save space and a disadvantage to PTI and Type Approval Authorities to quickly get access to information. He proposed to convey to the IWG on DETA and IWVTA that GRPE thought that the disadvantages of UI outweighed their advantages. The representative from CITA believed embedded UI could be of use and again invited to further scrutinize the UI implementation for an optimum implementation for all parties.
82. The representative from the European Commission invited by the ambassador to change “smoke coefficient” by “absorption coefficient” in the remarks of Table for UN Regulation No. 24 in GRPE-87-21.
83. The Chair concluded that further remarks can be sent to the GRPE ambassador.

58. The representative of Germany, Chair of the IWG on DETA, presented WP.29-188-18, introducing WP.29-188-19, the draft report of the fourty-fifth session of the IWG on DETA and also updating WP.29 on the work done during that session, held in Geneva on 10 November 2022. He laid out the current state of play, noting the number of approvals uploaded. He detailed activities of the IWG related to the Unique Identifier (UI) and suggested to circulate WP.29-188-20 to the GRs, containing proposed actions for the IWG on DETA, GRs and WP.29 as well as a table for the assessment of UN Regulations under the purview of the respective GR regarding the usage of UI. He reported on the progress related to the DETA feature for the mass upload of type approvals and the implementation by three Type Approval Authorities. He reiterated the request for decision by WP.29 regarding the access to DETA by Technical Services in case these Technical Services are performing an authoritative task under governmental control (as opposed to other Technical Services being commercial economic operators).
59. The representative of France commended the work of Germany in setting the upload function on the database and informed WP.29 that France would use the upload to ensure its functionality in France. He volunteered to give a feedback to WP.29 on the use of this functionality in case any issue would arise.
60. The representative of Spain suggested that WP.29 allow all Technical Services to have access to DETA. The representative of the United Kingdom of Great Britain and Northern Ireland raised a question regarding the access to DETA for Technical Services, in particular concerning the commercial confidentiality of the information contained in the system. He suggested that Technical Services would only be granted access to approval pursuant to UN Regulations for which they are nominated by their Type Approval Authorities. WP.29 concluded that further elaborations were needed and recommended the group to define criteria regarding the access to information in DETA.
61. WP.29 invited all the Contracting Parties to start the work for allowing relevant organisations to upload all the approvals they issue to DETA.
62. WP.29 authorized the group to distribute informal document WP.29-188-20 to its subsidiary bodies.
63. The representative of France suggested that the IWG would elaborate a standard clause to be used in any UN Regulation for prohibiting the use of UI. In this respect, the representative of Germany, Chair of IWG on DETA suggested that an amendment to Schedule 5 of the 1958 Agreement could also be considered. WP.29 agreed that these suggestions should be considered by its subsidiary bodies.
64. The secretariat reminded the World Forum that the situation related to hosting DETA at UNECE remained unchanged. The representative of the United States of America reconfirmed their objection to the hosting of DETA at ECE under regular budget.
65. The World Forum thanked Germany for continuing to host DETA.

8. The expert of IWG SLR presented draft amendments to UN Regulations Nos. 148, 149 and 150 that introduce summary documents to be placed in the electronic Database for the Exchange of Type Approval documentation (DETA) to support the use of the Unique Identifier (UI) (ECE/TRANS/WP.29/GRE/2022/10, ECE/TRANS/WP.29/GRE/2022/11 and ECE/TRANS/WP.29/GRE/2022/12). GRE pointed out that a template summary document should be developed by IWG DETA and endorsed by WP.29. Awaiting WP.29 and/or IWG DETA guidance on the matter, GRE decided to continue consideration at the next session.
9. GRE noted that the use of UI for a particular UN Regulation should only be possible when the following two conditions are met: - the corresponding summary document has been defined in the Regulation; and
- DETA is providing access to the Summary Document.
10. To stress these requirements, the expert from EC proposed an amendment (GRE-87-24-Rev.1). GRE adopted the proposal and requested the secretariat to submit it for consideration and vote at the March 2023 sessions of WP.29 and AC.1 as a draft Supplement to the 00 and 01 series of amendments to UN Regulations Nos. 148, 149 and 150.
11. In the context of possible replacement of traditional approval markings by UI, the expert from CITA presented a proposal with the aim to ensure the availability of sufficient information on the device for periodic and roadside inspections (ECE/TRANS/WP.29/GRE/2022/13 and GRE-87-07). GRE agreed to revert to this proposal at the next session.

31. The expert from the Netherlands, secretary of IWG DETA, introduced GRSG-124-15, recapping the examples that explain where a Unique Identifier (UI) marking could be used. The expert from CLEPA introduced GRSG-124-21, reproducing a first screening of UN Regulations annexed to the 1958 Agreement focusing on component related UN Regulations and on UN Regulations requiring additional markings to the approval markings. He added justifications for the prohibition of UI in UN Regulations Nos. 43 (Safety glazing) and 55 (Mechanical coupling). The expert from Finland, recalled to GRSG the position of the Working Party on Lighting and Light-Signalling (GRE) at its April 2022 session: for an efficient application of UI in the context of simplified UN Regulations, a summary document should be made available in DETA and that a template for the summary document should, as soon as possible, be introduced into these UN Regulations by means of a Supplement (ECE/TRANS/WP.29/GRE/86, paragraph10). The expert from CITA agreed with the position of the expert from CLEPA. He also added that UN Regulations Nos. 46 and 58 should exclude the introduction of UI and announced a document for the March 2023 session of GRSG that provides justification for implementing UI only when it is explicitly requested and in evidence of a clear advantage. GRSG agreed to resume discussion at its March 2023 session on the basis of the principle agreed by WP.29 that any prohibition of UI be clearly specified in the concerned UN Regulation. 114. The secretariat presented GRVA-14-05 and Rev.1, listing the UN Regulations under the purview of GRVA for which the use of the Unique Identifier (UI), as defined in Schedule 5 of the 1958 Agreement, would not be permitted. The expert from the Netherlands stated that, in general, UI did not provide many benefits and would create issues related to enforcement and periodic technical inspection. GRVA discussed whether UI provisions would need to be introduced in selected UN Regulations for the sake of uniform application and agreed to resume discussion in January 2023.

114. The secretariat presented GRVA-14-05 and Rev.1, listing the UN Regulations under the purview of GRVA for which the use of the Unique Identifier (UI), as defined in Schedule 5 of the 1958 Agreement, would not be permitted. The expert from the Netherlands stated that, in general, UI did not provide many benefits and would create issues related to enforcement and periodic technical inspection. GRVA discussed whether UI provisions would need to be introduced in selected UN Regulations for the sake of uniform application and agreed to resume discussion in January 2023.

The expert from Switzerland reserved their position on this matter.

In the context of possible replacement of traditional approval markings by UI, the expert from CITA presented a proposal with the aim to ensure the availability of sufficient information on the device for periodic and roadside inspections (ECE/TRANS/WP.29/GRE/2022/13 and GRE-87-07). GRE agreed to revert to this proposal at the next session.

110. The representative from Germany, Chair of the IWG on DETA, presented
(WP.29-187-27) the report (WP.29-187-26) to the World Forum related to the use of DETA and also updating WP.29 on the work of the IWG at its forty-fourth session, held on 9 June 2022. He laid out the current state of play, noting the number of approvals uploaded. He detailed activities of the IWG related to contracting and implementation of Unique Identifier (UI). He conveyed the question from the IWG to WP.29 whether UI provisions should be introduced in UN Regulations that do not specifically prohibit the use of UI, as per para. 3 of Schedule 5 to the Revision 3 of the 1958 Agreement and offered the position of the group regarding opening the access to DETA to technical service performing sovereign tasks on behalf of contracting parties.
111. The representative of OICA proposed to postpone the signature of the contract for the development of the UI module as recent questions arose that would need to be clarified before developing the feature.
112. The representative of European Commission offered tentative views according to which all UN Regulations should include, in line with the provisions of the revision 3 of 1958 Agreement, UI related provisions for supporting uniform applications of the Regulations.
113. The representative of the United Kingdom of Great Britain and Northern Ireland held the view that there could be confusion in the market place, in the absence of provisions supporting uniform implementation of UI.
114. The representative of France recalled that the 1958 Agreement allows the use of UI as an alternative to the approval mark provisions in UN Regulations, unless provision prohibit the use of UI, at the condition that the Approval is uploaded in DETA. He added that, nevertheless, the use of UI could have implications for the contracting parties that would require further guidance and lead-time.
115. The representative of CITA mentioned the potential benefits of UI if details were well considered. He suggested that further work would be performed before making use of UI. Upon invitation by the Chair, he presented WP.29-187-15, showing potential negative impacts of UI if not carefully developed.
116. The representative of OICA stated that there was no intention to hamper sovereign activities and that UI should not replace marking that needs to remain on the products. He added that possibly a horizontal document could be developed to detail the precise UI provisions (e.g. format, size, etc), to which all relevant UN Regulations could refer.
117. The representative of Finland, Chair of GRE recalled the 1958 Agreement provisions related to UI and explained the GRE considerations when introducing UI provisions in UN Regulations Nos. 148, 149 and 150. He recalled that CITA made a presentation at the IWG on SLR and that further discussions would take place in the near term to address concerns raised.
118. The representative of European Commission shared some of the concerns raised by CITA and recalled that: - the absence of a specific reference to UI in UN Regulations could lead to confusion if the choice of the use of UI or of a traditional marking was left to economic operators;
- IWG on SLR should reflect the inclusion of additional markings to facilitate the periodic checks or roadside verifications;
- if no solution can be found before the UI software become operational, a temporary freeze of UI in the lighting regulations should be considered.
119. The representative of the Republic of South Africa recalled the importance of markings when verifications of vehicles, systems and parts was at stake. He urged WP.29 to make UI and its use user-friendly.
120. The representative of Sweden announced that he would perform an analysis of the situation in his country to evaluate the potential negative impact of DETA as presented by CITA.
121. The representative of the United Kingdom of Great Britain and Northern Ireland mentioned the importance of approval marking, not only for periodic technical inspection and roadside inspections but also in other cases. He mentioned as an example the existing requirements at the point of sale and felt that a large number of national regulations could be impacted by UI and could require amendments.
122. WP.29 agreed that further work was needed within the IWGs on DETA and SLR. WP.29 recalled the use of markings beyond the context of vehicle approval, having importance at all stages of the vehicle lifetimes, from approval to registration and down to decommissioning. WP.29 noted the crucial importance of the access to information and also to consider modern technology such as XML formats as PDF files were no longer state of the art.
123. WP.29 could not provide a final answer to the question raised by the IWG on DETA related to UI but expressed support for further work for the sake of simplification, uniform implementation of UI.
124. WP.29 adopted ECE/TRANS/WP.29/2022/62 (under agenda item 4.5.1).
125. The Secretary proposed to WP.29 to consider marrying the Document of Conformance (DOC) and UI for further benefits to citizens. He mentioned as an example the difficulties experiences by citizens in order to receive e.g. stickers as required in order to enter Low Emission Zones.
126. The Secretary confirmed that there was no new development regarding the budget for hosting DETA at UNECE. WP.29 thanked Germany for hosting DETA for the time being.

The representative of France recalled that the 1958 Agreement allows the use of UI as an alternative to the approval mark provisions in UN Regulations, unless provision prohibit the use of UI, at the condition that the Approval is uploaded in DETA. He added that, nevertheless, the use of UI could have implications for the contracting parties that would require further guidance and lead-time.
115. The representative of CITA mentioned the potential benefits of UI if details were well considered. He suggested that further work would be performed before making use of UI. Upon invitation by the Chair, he presented WP.29-187-15, showing potential negative impacts of UI if not carefully developed.
116. The representative of OICA stated that there was no intention to hamper sovereign activities and that UI should not replace marking that needs to remain on the products. He added that possibly a horizontal document could be developed to detail the precise UI provisions (e.g. format, size, etc), to which all relevant UN Regulations could refer.
117. The representative of Finland, Chair of GRE recalled the 1958 Agreement provisions related to UI and explained the GRE considerations when introducing UI provisions in UN Regulations Nos. 148, 149 and 150. He recalled that CITA made a presentation at the IWG on SLR and that further discussions would take place in the near term to address concerns raised.
118. The representative of European Commission shared some of the concerns raised by CITA and recalled that: - the absence of a specific reference to UI in UN Regulations could lead to confusion if the choice of the use of UI or of a traditional marking was left to economic operators;
- IWG on SLR should reflect the inclusion of additional markings to facilitate the periodic checks or roadside verifications;
- if no solution can be found before the UI software become operational, a temporary freeze of UI in the lighting regulations should be considered.
119. The representative of the Republic of South Africa recalled the importance of markings when verifications of vehicles, systems and parts was at stake. He urged WP.29 to make UI and its use user-friendly.
120. The representative of Sweden announced that he would perform an analysis of the situation in his country to evaluate the potential negative impact of DETA as presented by CITA.
121. The representative of the United Kingdom of Great Britain and Northern Ireland mentioned the importance of approval marking, not only for periodic technical inspection and roadside inspections but also in other cases. He mentioned as an example the existing requirements at the point of sale and felt that a large number of national regulations could be impacted by UI and could require amendments.
122. WP.29 agreed that further work was needed within the IWGs on DETA and SLR. WP.29 recalled the use of markings beyond the context of vehicle approval, having importance at all stages of the vehicle lifetimes, from approval to registration and down to decommissioning. WP.29 noted the crucial importance of the access to information and also to consider modern technology such as XML formats as PDF files were no longer state of the art.
123. WP.29 could not provide a final answer to the question raised by the IWG on DETA related to UI but expressed support for further work for the sake of simplification, uniform implementation of UI.
124. WP.29 adopted ECE/TRANS/WP.29/2022/62 (under agenda item 4.5.1).
125. The Secretary proposed to WP.29 to consider marrying the Document of Conformance (DOC) and UI for further benefits to citizens. He mentioned as an example the difficulties experiences by citizens in order to receive e.g. stickers as required in order to enter Low Emission Zones.
126. The Secretary confirmed that there was no new development regarding the budget for hosting DETA at UNECE. WP.29 thanked Germany for hosting DETA for the time being.

The expert from China introduced GRVA-13-31, explaining the activities performed in China regarding the elaboration of a national standard on the basis of UN Regulation No.155, the difficulty related to the lack of pass/fail criteria in the Regulation and mentioning the difficulty for China to perform the peer review as prescribed in para. 5.3. to the regulation, in the absence of access to the Database for Exchange of Type Approval documentation (DETA).
49. The expert from the United States of America pointed out at ECE/TRANS/WP.29/2022/60 and suggested to develop that document further, if needed, to address China’s concern.
50. GRVA agreed to address China’s request and decided to organize, before the summer break, a technical workshop on the implementation of Cyber Security provisions under the 1958 and 1998 Agreements, on the model of those already organized for the implementation of UN Regulation No. 155. GRVA invited Japan and the Secretary to organize it as a virtual meeting in English only. GRVA hoped to receive a report on this workstream at the September 2022 session of GRVA.

110. The representative from Germany, Chair of the IWG on DETA, presented
(WP.29-187-27) the report (WP.29-187-26) to the World Forum related to the use of DETA and also updating WP.29 on the work of the IWG at its forty-fourth session, held on 9 June 2022. He laid out the current state of play, noting the number of approvals uploaded. He detailed activities of the IWG related to contracting and implementation of Unique Identifier (UI). He conveyed the question from the IWG to WP.29 whether UI provisions should be introduced in UN Regulations that do not specifically prohibit the use of UI, as per para. 3 of Schedule 5 to the Revision 3 of the 1958 Agreement and offered the position of the group regarding opening the access to DETA to technical service performing sovereign tasks on behalf of contracting parties.
111. The representative of OICA proposed to postpone the signature of the contract for the development of the UI module as recent questions arose that would need to be clarified before developing the feature.
112. The representative of European Commission offered tentative views according to which all UN Regulations should include, in line with the provisions of the revision 3 of 1958 Agreement, UI related provisions for supporting uniform applications of the Regulations.
113. The representative of the United Kingdom of Great Britain and Northern Ireland held the view that there could be confusion in the market place, in the absence of provisions supporting uniform implementation of UI.

94. The representative of the Russian Federation, Co-Chair of the IWG on Periodical Technical Inspections (PTI) reported to WP.29 on the activities of the IWG at its twenty-fifth and twenty-sixth sessions, held in a virtual format. He informed WP.29 that the work of the IWG had focused on for areas: - In-service compliance assessment;
- Measures to detect tampering;
- Draft Rule on Accident Emergency Call Systems;
- Access to DETA.
He explained that the framework document would be further developed by a subgroup of the IWG on PTI.
95. The Co-Chair of the IWG on PTI sought guidance from WP.29 on elements of its activities related to the framework document on in-service compliance which aimed to address market surveillance mechanisms for the robust verification of compliance of the automotive products.
96. The representative of France, Chair of GRBP, reported on the related discussions in his group. The highlighted the need to define the right interface between vehicle approval (including Conformity of Inspection, In-service Conformity and Market surveillance in some markets) and periodic technical inspection. He stated the importance of making sure that reference tests performed within the framework of type approval would need to be adequately used in PTI and road side inspection.
97. The representative from the UK recalled the inclusion of penalties for non-compliance was mentioned by the IWG on PTI, which predominantly exist in national legislation. He requested the view from WP.29 about the role of 1997 agreement to make recommendations on penalties, and shared his view that this was probably the prerogatives of each contracting parties. The Chair agreed with the UK statement, and added that contributing to roadworthiness tests was a useful added value of the 1997 Agreement deliverables.
98. The representative from Sweden supported the statement from the UK and highlighted the importance to carry on activities to reveal tampering in PTI and roadside tests and invited the IWG on PTI to continue and expand their activities on that matter.
99. The representative from CITA agreed that WP.29 was not mandated to defining penalties, and thanked the UK and Sweden for the constructive feedback.
100. The secretariat on behalf of GRPE Chair supported the approach described by the Co-Chair of the IWG on PTI, and informed GRPE will be seeking active implication from GRPE stakeholders during its June 2022 session.
101. The representative of France commented on the envisaged access to DETA for the purpose of PTI. He highlighted the importance of considering appropriate uniform data structure stored in DETA that could be used of PTI.
102. The representative of CITA explained that the current developments of UI could create serious issues in the course of PTI inspections and therefore would need to be properly developed to accommodate sovereign tasks and needs such as PTI.
103. WP.29 acknowledged that some regions already developed provisions related to data for PTI and that such matter could be discussed in this forum. OICA commented that those markets require information exchange on the basis of Vehicle Identification Numbers while DETA was structured based on Approval numbers and vehicle types.

He added that, concerning the DETA scope extension, the IWG on DETA discussed the potential access to cyber security related information by the contracting parties of the 1998 Agreement and the access in the course of Periodic Technical Inspection (by the contracting parties of the 1997 Agreement). He reported that, following the consultation of the GRs concerning UI and the proposal for a “summary document” stored in DETA, the group discussed that the GRs would probably need to draft provisions, in the relevant UN Regulations, with the markings without UI and the markings with UI.
73. WP.29 requested the secretariat to distribute WP.29-185-13 with an official symbol at the next WP.29 session.
74. The representative of CITA invited the IWG on DETA and WP.29 to consider the PTI needs related to UI.
75. The representative of UK enquired whether DETA would provide the necessary confidentiality that would permit to open the access of DETA to the PTI stakeholders.
76. WP.29 did not oppose to provide in the near future access to DETA to the PTI stakeholders. It required the IWG on DETA to provide, at the June 2022 session, assurance to WP.29 that the necessary confidentiality would be warranted so that such access could be granted.
77. WP.29 invited GRVA to resume discussion on cyber security and DETA and then to advice the IWG on DETA.

61. The GRPE ambassador to the IWG on IWVTA introduced GRPE-85-01 and
GRPE-85-33 to initiate discussions in GRPE about the implementation of the Unique Identifier (UI) in UN Regulations pertinent to GRPE. The representative from CITA, secretary of the IWG on Periodic Technical Inspection (PTI), underlined the importance of broad access to reliable information, especially for PTI centres that are the first users of approval markings. He asked the ambassador that GRPE-85-01 be also introduced to the IWG on PTI.
62. The representative from the EC sought further clarification on user access to UI. The representative from Australia asked if the work on UI should prioritize UN Regulations included in UN Regulations No. 0.
63. The GRPE ambassador to the IWG on IWVTA noted all requests for further information and agreed to raise them during the next meeting of the IWG on DETA, to be held in March 2022 and to report back during the next session of GRPE.
